Welcome to LumaShot LLC. These Terms of Service ("Terms") constitute a legally binding contract between you and LumaShot LLC governing your access to and use of our website, applications, APIs, and media hosting services (collectively, the "Service"). By accessing the Service, you signify that you have read, understood, and agree to be bound by these Terms.

PLEASE READ CAREFULLY: THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT REQUIRE YOU TO RESOLVE DISPUTES THROUGH ARBITRATION ON AN INDIVIDUAL BASIS.

1. Access to the Service

1.1 Age Requirements: You must be at least 13 years old (or the minimum legal age in your country) to use the Service. If you are a minor, you represent that you have legal guardian consent.

1.2 Business Accounts: If you are opening an account on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to legally bind that entity and grant us all necessary permissions.

2. Permitted Use & Restrictions

Your license to use the Service is contingent upon compliance with the law. You are expressly prohibited from:

  • Automated Scraping: Accessing the Service using bots, spiders, or unauthorized APIs to systematically download data or video assets.
  • Security Bypassing: Circumventing Digital Rights Management (DRM), regional geoblocks, or attempting to probe our infrastructure vulnerabilities.
  • Deceptive Practices: Generating artificial engagement (purchasing bot views, spamming comments) or impersonating other creators/brands.

3. User Content & Intellectual Property

3.1 Your Ownership: LumaShot LLC does not claim ownership over the media you upload. You retain 100% of your intellectual property rights.

3.2 License Granted to LumaShot: By providing Content to the Service, you grant LumaShot LLC a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, transcode, distribute, display, and perform that Content strictly for the purpose of operating and improving the platform's global CDN.

4. Limitation of Liability

To the maximum extent permitted by applicable law, LumaShot LLC, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or inability to access the Service; (b) any conduct or content of any third party on the Service.

5. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California.
