LumaShot LLC respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), we will respond expeditiously to claims of copyright infringement committed using our Service.
1. Repeat Infringer Policy (The 3-Strike Rule)
Strict Enforcement
LumaShot LLC maintains a strict Repeat Infringer Policy. If an account accrues three (3) valid copyright strikes, the account, along with all associated channels and media assets, will be permanently terminated without the possibility of restoration.
2. Filing a DMCA Takedown Notice
If you are a copyright owner or an agent thereof, and you believe that any content hosted on LumaShot LLC infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (e.g., original source URL, registration number).
- Identification of the material that is claimed to be infringing, providing specific LumaShot LLC URLs or Video IDs.
- Information reasonably sufficient to permit LumaShot LLC to contact you (Email address, telephone number, physical address).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
3. Counter-Notification Procedure
If you believe that your content was removed by mistake or misidentification (including claims of Fair Use under 17 U.S.C. § 107), you may file a Counter-Notice. If a valid Counter-Notice is received by our Legal Department, LumaShot LLC may restore the removed content in 10 to 14 business days, unless the original claimant files an action seeking a court order against you.
